Republican Texas clerk refuses to issue marriage license application for same sex couples

The Denton County Clerk Juli Luke refused two same-sex couples an application for a license Friday, saying first that she needed to receive legal guidance from the district attorney's office. 

Later, she announced that the office would not be issuing licenses because they needed to update their computer software. 

Another same-sex couple in The Colony said they started calling other county satellite offices looking for one that would issue a license. They, too, were refused. 

Denton County Judge Mary Horn said that, at this point, if a same-sex couple came to her requesting to be wed, she would refuse them. 

She said that the difference between the actions of elected officials in Dallas County and Denton County on Friday reflected "a difference in core philosophies."

Every county level elected office in Denton County is held by a Republican.

The Denton County Clerk Juli Luke refused a second couple a marriage license application Friday morning. 

District Attorney Paul Johnson said the decision whether to issue licenses belonged to the clerk's office. 

A sign on the clerk's door said that the office would not be issuing same-sex licenses today because of "changes that must be made for our vendor." 

No explanation was provided.

11:30 p.m.

Republican Denton County Clerk Juli Luke refused to provide Tod King and Casey Cavalier a marriage license application this morning, telling them she needed guidance from Denton County District Attorney Paul Johnson, also a Republican. 

In Dallas County, where Democrats hold many more elected offices, clerks are issuing marriage licenses and justices are standing by to marry couples who receive their license.

Denton County Clerk Juli Luke issued a statement that she would defer to guidance from Denton District Attorney Paul Johnson before issuing any marriage licenses in Denton County today to same sex couples. 

"It appears this decision now places our great state in a position where state law contradicts federal law," Luke wrote. 

A member of the local Stonewall Democratic club said she wasn't sure anyone would apply to the Denton County Clerk's office. 

"She's been pretty vague about it," Sandy Swan said. 

Local activists plan a rally in support of today's decision beginning at 6 p.m. on the Square tonight.
