Man who was given suspended sentence for attacking Royal Marine posted a picture of champagne on Facebook saying it was 'time to celebrate' and 'I win' recalled to court by judge and sentenced to 12 months prison.

A man who gloated on social media after beating a Royal Marine in a car park in Camborne has been jailed for the original assault.

Ben Scott, a builder from Town Farm, Redruth, was originally spared jail after attacking Corporal Marc Jolly outside the Tyacks Hotel in Camborne.

After avoiding jail he posted a picture of champagne on Facebook saying it was 'time to celebrate' and 'I win'.

Today he was recalled to Truro Crown Court to face the judge who originally spared him prison and was given a 12 month sentence, half of which will be spent behind bars.

The judge described the posting on Facebook as a "stupid and gloating comment" and said he must "face the consequences of his stupid and arrogant behaviour".

Sentencing Judge Christopher Harvey Clark QC said: "Regarding your recent Facebook posts you described your comment as as stupid and gloating comment. It was worse than that.

"You treated the victim of this brutal assault with contempt and treated the court's decision with contempt.

"Your remark was 'I win' and today you must accept the consequences of your stupid, arrogant behaviour.

"I make allowance for the fact you have apologised profusely through Mr Jeremy Leaning but sentence you to 12 months immediate imprisonment of which you must serve at least six months.

"If this means your employees are laid off then they and their family and friends should blame you."

Speaking to the West Briton today, Corporal Marc Jolly, who served in Afghanistan with the Royal Marines, said: "It's good to know that he has finally got the sentence he deserves but I don't think he is the kind of person who will drop it just like that.

"His Facebook post was disgraceful and made a mockery of the justice system so he should now just get on with it and do the time and then we can all put all of this behind us and move on with our lives."

Scott had been called back to Truro Crown Court today after a huge public outcry following the West Briton's revelation that he had gloated on Facebook after beating Corporal Jolly on Christmas Eve last year.

Scott had attacked Corporal Jolly from behind, stamping and kicking him at least 14 times in a vicious attack that left him with three head wounds.

Corporal Jolly had said that the attack on the streets of his home town had left him more scared than he had been whilst serving in Afghanistan.

He said: "It really did affect me. I didn't go home for quite a few months. I didn't want to walk around and bump into him.

"I didn't feel comfortable going back to my home town, when I'd done nothing wrong. The first time was a couple of weeks ago, and I didn't feel safe.

"I'd rather be back in Afghanistan. At least you know what you're getting into - you're prepared for it - but you don't expect someone to come up and hit you on the back of the head."

The Corporal Jolly attack occurred only a few months after a fellow British serviceman, Dave Curnow, had been attacked and killed.

Police in Camborne had said that the attack on Corporal Jolly was "incredibly cowardly" and felt his gloating Facebook post showed a "complete lack of disregard for the courts".
